That on November 13, 2007, in compliance with the provisions of Article 46 section I of the Federal Law on Metrology and Standardization, the Ministry of Labor and Social Welfare submitted to the National Advisory Committee on Occupational Safety and Health Standardization, the Preliminary Draft Amendment to this Mexican Official Standard and that the said Committee considered it correct and agreed that it be published as a Draft in the Official Gazette of the Federation;
That in order to comply with the provisions of Articles 69-E and 69-H of the Federal Law of Administrative Procedure, the corresponding Preliminary Draft was submitted to the consideration of the Federal Commission for Regulatory Improvement, which ruled favorably in relation to the same;
That on April 29, 2008, in compliance with the Agreement of the National Advisory Committee for Standardization of Safety and Health at Work and the provisions of Article 47 section I of the Federal Law on Metrology and Standardization, the Draft Amendment to the Mexican Official Standard NOM-001-STPS-1999, Buildings, premises, Buildings, premises, facilities and areas in workplaces-Safety and hygiene conditions, to become PROY-NOM-001-STPS-2007, Buildings, premises, facilities and areas in workplaces-Safety conditions, so that, within 60 calendar days of such publication, interested parties could submit their comments to the National Advisory Committee for Occupational Safety and Health Standardization;

6 Obligations of the employer To have clean and safe toilets, urinals, sinks, among others. There shall be places reserved for food consumption. According to NOM-001-STPS-2008, Buildings, premises, facilities and areas in workplaces – safety conditions (NOM), all employers must maintain the facilities in the buildings where their workers provide their services in safe conditions (point 5.1, NOM).
Point 11.5 of the NOM allows verifications to be programmed by area, so that the offices under investigation alternate, with the condition that the 12-month period is complied with in each one of them.
Failure to comply with the provisions of the NOM will result in the company being subject to a fine of 50 to 5,000 times the UMA, which range from 4,344.50 to 434,400.00 pesos.
However, since the LFT also penalizes those who violate safety and health standards, from 250 to 5,000 UMA, which is equivalent to 21,720.00 to 434,400.00 pesos, and this is hierarchically superior to the RFSST, these penalties are the ones that should prevail.
Finally, the employer sector must consider that by complying with the NOM, conditions for safeguarding the health of employees in the workplace are created, which will allow for the implementation of safety measures to prevent the generation of the so-called psychosocial risk factors.
